Qualifying for preference when importing from the EU
HMRC have provided a flowchart which will be useful when trying to decide if your goods qualify for preference when importing from the EU.
Those wishing to re-export EU goods from the UK may also find it useful. Download the flowchart here.
Preferential tariff rates on Chile exports
DIT have confirm that, as of 12 January 2021, preferential tariff rates on UK exports to Chile, as set out in the agreement, are being applied.
For goods imported to Chile from the UK between 1 January 2021 and 12 January 2021, preferences are being applied retrospectively. Businesses can claim back any additional tariffs paid since 1 January 2021 from the Government of Chile. The Government of Chile has issued guidance on this rebate scheme (Chapters III and IV).
EUR1’s can be issued going forward to claim preference.
Rules of Origin
The UK and the EU have agreed that supplier declarations on origin don’t need to be in place for the first twelve months. Supplier declarations will need to be available if requested for goods imported during that twelve month period, but a request would only be made after the twelve months.
Preferential tariff claims can be made up to three years after import. A C285 form will be required for a repayment request in the UK.
In the UK, only a UK EORI number is needed from HMRC. No HMRC authorisation of any origin documentation is required for this FTA.
There are several interim product specific rules for electric accumulators and electrified vehicles annexed to the Agreement. Click here for more information.
